Terms of service

ListingShot AI is a subsidiary of Haven Springs LLC. These Terms govern your use of the ListingShot AI website, photo tools, and related services (the “Service”). References to “we,” “us,” and “our” mean ListingShot AI and Haven Springs LLC. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts and authority

You must have legal capacity to enter this agreement. If you use the Service for a brokerage, client, or other organization, you represent that you have authority to bind that organization. Provide accurate account information, protect your sign-in credentials, and notify us of suspected unauthorized use. You are responsible for activity you authorize through your account.

2. Your photos and permissions

You retain any rights you hold in your original photos. You must own or have all necessary permissions to upload, import, edit, and publish the photos, including photographer licenses and any required privacy, property, or publicity permissions. A publicly accessible listing is not permission to copy its images. Do not upload sensitive personal information or images you are not authorized to process.

You grant us a limited license to store, reproduce, transmit, and modify your submitted content as necessary to operate the Service, generate results, prevent abuse, and meet legal obligations. Subject to third-party rights and these Terms, you may use full-resolution results you have unlocked for your listings and commercial marketing. We do not guarantee that AI-generated material is copyrightable, exclusive, or free of third-party claims. Watermarked previews do not provide access to clean, full-resolution files; do not bypass watermarks or download restrictions.

3. AI results and truthful listings

AI results can contain mistakes, invented details, or changes that do not accurately reflect the property, even when our tools aim to preserve property fidelity. Review every result against the original photograph and the actual property before publishing. Reject or correct any misleading result. The Service is not a substitute for a property inspection, professional photography, legal advice, or independent verification.

Do not use the Service to conceal defects, misrepresent property condition, deceive buyers or renters, infringe rights, upload unlawful content, or circumvent security and payment controls. You are responsible for compliance with applicable advertising rules, fair housing laws, brokerage policies, listing-platform rules, and disclosure requirements. Use appropriate labels, including “AI Enhanced,” “Virtually Staged,” “Digitally Decluttered,” or “Day-to-Dusk · AI Altered,” as applicable. Our labels do not establish compliance in any particular market.

4. Monthly subscriptions and credits

New paid purchases are monthly subscriptions only. The price and credit allowance shown at checkout apply to your purchase. Subscriptions renew monthly and charge your authorized payment method until canceled. You can cancel through your account billing controls; cancellation stops future renewals and preserves access and unused monthly credits until the end of your paid billing period. Monthly credits expire at period end and do not roll over. Previously purchased Starter credits retain their original 12-month expiry.

Credits unlock full-resolution results. Credits charged for failed generations are returned automatically; this is a credit restoration, not a cash refund. Where subscription upgrades are available, they take effect immediately with prorated charges and the extra monthly credits granted immediately. Applicable consumer cancellation and refund rights remain unaffected. Credits have no cash value and are not money or a transferable financial asset.

Any future change to recurring prices or material subscription terms will be communicated in advance as required by law. The Service depends on third-party providers and may experience delays or interruptions. We may change or suspend features, or restrict accounts for misuse, security risks, or legal reasons, subject to applicable law and your paid subscription rights.

5. Founding Members at Zillow Unlock 2026

Make your first successful Pro payment before midnight at the end of October 14, 2026, Las Vegas time (October 15 at 07:00 UTC) to receive double Pro credits every paid billing period for life. At the current allowance, this is 60 rather than 30 credits. This is not a lifetime price guarantee. Membership survives cancellation and restores the benefit when you resubscribe; no credits are issued during unpaid periods. Monthly credits expire at period end with no rollover.

6. Refer a Realtor

Each new customer attributed to your personal referral link who makes a first paid Pro purchase earns you 30 bonus credits, valid one calendar month after issue. This is a photo-credit reward, not a waived subscription bill or cash payment. Self-referrals and duplicate rewards are not permitted. A refund of the qualifying purchase reverses the reward. We do not verify professional licensing. ListingShot AI is independent of Zillow and is not an on-site photography service.

7. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND AI RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ACCURACY, UNINTERRUPTED AVAILABILITY, SECURITY, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

We make no guarantee of listing approval, MLS compliance, buyer response, sales outcomes, property value, or savings. ListingShot AI is not affiliated with, endorsed by, or sponsored by Zillow or any MLS. References to events or platforms do not imply a partnership.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTINGSHOT AI, HAVEN SPRINGS LLC, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, OR DATA ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. THIS LIMIT APPLIES REGARDLESS OF THE LEGAL THEORY AND TO THE EXTENT PERMITTED EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including fraud, willful misconduct, gross negligence where protected by law, death or personal injury caused by negligence where protected by law, or mandatory consumer rights. Where an exclusion or limitation is not permitted, it applies only to the extent lawful.

9. Third-party claims

To the extent permitted by law, you agree to indemnify and hold harmless ListingShot AI, Haven Springs LLC, and their affiliates, officers, employees, and agents from third-party claims, damages, and reasonable legal costs resulting from your unlawful use of the Service, your violation of these Terms, your infringement of another person's rights, or your publication of misleading images. This obligation does not apply to the extent a claim results from our own unlawful conduct or liability that cannot legally be shifted to you. We will give reasonable notice of a claim and an opportunity to participate in its defense; no settlement may impose an admission or non-monetary obligation on you without your consent.

10. Privacy and third-party services

Our Privacy Policy explains our handling of personal information and photos. Payment processing, AI generation, authentication, and listing imports rely on third-party services. Their applicable terms may also govern your direct use of those services; we are not responsible for third-party websites or listing content.

11. Termination and general terms

You may stop using the Service at any time; stopping use alone does not cancel a subscription. We may suspend or terminate access for a material violation of these Terms or where necessary for security or legal compliance. Provisions concerning ownership, accrued payment obligations, warranties, liability, and third-party claims survive termination to the extent applicable.

If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and the purchase terms presented at checkout constitute the agreement concerning the Service. We will post updated Terms with a revised effective date and provide additional notice of material changes where required by law. Changes do not retroactively remove accrued rights or mandatory legal protections.
